I aim to respond in 2-3 working days to commission queries. Please note that commissions can take anywhere from 2 weeks to 3 months to complete depending on the commission type and possible real-life events.Additionally, all commissions are done via an invoice system. Breaking my TOS below can result in blacklisting, depending on the severity of the TOS break. I do not have a public blacklist and I will not be namedropping users or peoples who I will not accept commissions from as I consider it highly unprofessional and against other users privacy.

general tos.
It is your responsibility to read these, and by e-mailing me with a private inquiry or checking the 'read TOS' section on my Google Form you automatically agree to the below rules.
I will usually post your commission on social media, but if you would like me not to you must tell me before the commission is complete.
I provide watermarked WIPs for nearly every commission type! The only type that I do not provide WIPs for are minis; hence the lower price.
I need a clear reference to work from, these do not have to be complex or a serious reference sheet so long as you provide me with a flat-coloured image of sorts to colour pick from you will be fine.
Works presented here & the TOS for such are for private, personal usage commissions only, commercial work requests will need to be discussed beforehand and include an individual TOS/agreement based on the type of work I will be producing!
Any artwork I produce is a single-time purchase, ie: no NFTs may be attached to it.
Art Usage
IF YOU HAVE COMMISSIONED ART FROM ME FEEL FREE TO USE IT AS ICONS, PAGE DOLLS OR ANYTHING YOU WANT! DO NOT USE COMMISSIONED ARTWORK FOR OTHER PROFITS PLEASE. Once the commission is complete, you own the rights to distribute, display and use the artwork for any icons, backgrounds or assets that are for your personal usage only.
MY WORK MAY NOT BE USED TO GENERATE NFT'S OR AI; THIS CLASSES UNDER 'ADDITIONAL PROFITS'. You may not use my artwork to gain profits after purchase.
An un-watermarked version of my artwork will be provided to the commissioner only. If you upload/share this anywhere please be sure to provide the appropriate credit.
My work may not be used for other or commercial profits without asking for my permission first. Commercial profits include stickers, badges, posters, prints and plushies. Discussion of an additional cost if you wish to use my artwork for such after purchase is available and I encourage it.
Any commercial usage of my work will automatically include a watermark/signature on the final image, this cannot be removed without additional payment.
Additionally, usage of my artwork in paid advertisements is prohibited. Additional fees will apply if you wish to use my artwork in this manner.
You may use my artwork to add to the value of your characters, should you wish to sell them on/part with them.
Please note I may use your commission in the future to promote myself and my work, however, I will never use it for additional profits. I withhold the right to display and freely advertise the work under my portfolios, commission sheets or non-profit purposes. No money will be made directly off of your private commission without direct communication and discussion.
In short: so long as you aren't earning money out of my artwork after you've paid for it, you're free to use it anywhere you want.Please note I do not accept commissions that infringe the copyright of other’s characters or from official companies, or otherwise involve insensitive material that would offend anyone of a certain gender, race or ethical background.I can take one-off commissions for some licensed characters (ie: ones from companies that welcome one-off fanart etc), however, I can not offer them as sell-able prints. Yes, I will check to see if I am allowed beforehand.
COMMISSION PROCEDURE.
Choose what type of commission you would like and contact me via e-mail [[email protected]] (preferred) or social media DMs.
In a clear manner please describe what you would like, the best way to do this is by bullet points!
I reserve the right to deny a commission for whatever reasons I may have.
The rule of thumb with all of my commissions is that I require a minimum of a clear reference image for your character. Multiple images can be provided but please be clear if there is a specific image you wish me to colour pick from. Be sure these are HQ too.
After a mutual agreement on the price and final outcome, I will request the payment.
Progress/process images will be provided to the commissioner (excluding mini art), which will typically be the sketch and flat colours. I do my best to keep in contact with the commissioner about the progress of their commission throughout the process.
During the process stages, changes can be made for free with no additional charges. Thereafter a charge will apply to any further changes (unless it's minor such as a simple colour or marking error).
Your commission will take anywhere from 2 weeks to 3 months to fully complete (depending on complexity).
You will receive your finished commission through DMs or e-mail. If the communication is through DMs I will provide a link to the HQ image(s).
PAYMENTS & REFUNDS
Payment is through PayPal only.
I do not accept NFTs as payments.
All standard payments are upfront.
Payment plans are available, but only to those ordering commissions valued at over £70 ($100 USD).
Payment is expected within 72hrs of confirmation on your commission.
I will only start working on the commission once a payment has been received.
Refunds for work that I have not yet started are permitted.
Only 50% of a refund can be issued (max) if I have started work on your commission.
I will not accept refunds if the commission is completed.
Additional charges will apply if you ask for massive changes after the commission is complete.
If at any point I feel that I am unable to complete/continue your commission I will refund you the provided payment.
Once the work is fully complete, I will not accept refunds.
All payments must be paid in full before the final image is provided to you.
Custom designs etc.
By purchasing/trading/being gifted a design created by myself you understand and agree to the below rules…
You may not:
Buy designs directly from me with the intent of selling them on for more than their purchase price within 24hrs.
OR Sell/trade the design for more than its original purchase price.
Value to the character can be added on through commissions, gift art, traded art or your own work but that’s it!
Monetary value cannot be added to your characters based on “sentimental” feelings.
Sell the design to a company.
*Design changes etc that I do not allow are as follows…
Completely changing the colour pallete while keeping markings
Reusing base concepts to create ‘new’ versions of the same character.
Creating a closed species from my design (without discussion with me beforehand)
Full thematic changes, ie: changing the theme of a character from fire to galaxy. Changing it to another element such as water would be fine, but ultimately it ruins the design otherwise.
The above design rules are in place if you plan on separating the designs. If they are just ‘tabs’ or alts of the same character this is fine! These however MUST remain attached to the character and sold alongside the design. I do not want to be in a position where there’s a hue-shifted blue version of the same character out there as well as the original character. It makes things difficult for myself as if someone comes back to me with an issue (as the original seller) I can’t really do anything.
You may:
Slightly modify the design. Permitted changes are as follows…
Name, pronouns, gender, backstory, body shape, species, remove unwanted details (ie: antlers, five fingers to four) shift around markings, slightly alter colours, add colours, remove colours.*
Sell the character/trade the character for a lower value.
Draw whatever kind of art you want for them, they’re your character to do as you wish with!
Claim ownership to the design itself, (noted this does not mean the creation, merely the rights to the concept).
This means that you own the rights to the character design itself and are free to commission artwork, edit, change, modify or alter my base concept as well.
You cannot take credit for the original 'reference sheet'/concept sheet, however. I withhold the rights to this concept and the base creation of the character illustration.
In short, I am selling the 'design' to you, not the rights to the artwork. Additional fees will apply if you wish to distribute the artwork as your own property (think of it like a logo).
Post the design elsewhere without credits.
I only ask for credits as the designer and artist, you do not have to credit me every time! Though it is appreciated.
Reference the design/take inspiration from the design to create alternative versions.
It would also be nice to keep my characters traded to Toyhou.se users only! That way anyone can track the ownership history and there is no confusion.
I recognise I can not enforce these rules fully or completely 'revoke' designs, and you are honestly free to do what you want online, however these are a TOS that I have put in place to allow me to stay out of trouble. Be aware if you break these frequently or put me in an awkward position, I will blacklist you from my work. This is more so for my own sanity than yours.
